- OVERVIEW
These Terms of Service (“Terms of Service”) set forth the general terms and conditions of your use of this website (“Site”) and the products and services purchased or accessed through this Site (individually and collectively, the “Services”).
These Terms of Service and the documents to which they refer form an agreement (“Agreement”) between HostGete (“HostGete”) and you. The Agreement is made effective as of the date of your use of the Site or the date of electronic acceptance thereof, whichever occurs earlier.
The terms “we”, “us”, or “our” shall refer to HostGete. The terms “you”, “your”, “User”, or “Customer” shall refer to any individual or entity who accepts this Agreement, has access to a Customer account at HostGete (“Account”), or uses our Services.
- HOSTGETE CONTRACTING ENTITY AND APPLICABLE TERMS AND POLICIES
Unless otherwise indicated in specific agreement documents, the sole contracting entity for all Users and Services is HostGete, operating from West Bengal, India. By accessing this Site or purchasing our Services, you are entering into a legally binding contract with HostGete.
Your use of this Site and our Services is also governed by the following applicable agreements and policies, which are incorporated into these Terms of Service by reference:
- Hosting Agreement / Acceptable Use Policy (AUP)
- Domain Registration Agreement
- Refund Policy
- Privacy Policy
- Other specific service terms made available to you on our Site.
When your use of the Site or the Services requires us to process any personal data or personal information, we will do so strictly in accordance with our Privacy Policy, which is also incorporated into these Terms of Service by reference.
Your electronic acceptance of these Terms of Service signifies that you have read, understood, and agreed to be bound by this Agreement along with all applicable policies.
HostGete may, in its sole and absolute discretion, change or modify these Terms of Service and any policies or agreements incorporated herein at any time, and such changes shall be effective immediately upon posting to this Site. In addition, HostGete will notify you via email or a client dashboard alert within a reasonable period prior to the effective date of any material changes to the Agreement. In the event of a material change that is to your detriment, you maintain the right to terminate the Agreement by providing written notice within 30 calendar days from the date of notification. Your continued use of this Site or the Services after any changes or modifications shall constitute your full acceptance of the Agreement as last revised.
- ELIGIBILITY AND AUTHORISATIONS, SANCTIONS COMPLIANCE
This Site and the Services are available only to persons or legal entities who can form legally binding contracts under applicable law.
By using this Site or our Services, you represent and warrant that you:
(i) Are at least eighteen (18) years old or have reached the legal age of majority in your jurisdiction;
(ii) Have the full legal capacity to enter into a binding agreement with us;
(iii) Are not a person or entity barred from purchasing or receiving the Services under the laws of India or any other applicable jurisdiction; and
(iv) Meet all conditions for the purchase and/or use of the Services, including compliance with international trade and anti-money laundering regulations.
If you are entering into this Agreement on behalf of a corporate entity, company, or organization, you represent and warrant that you have the legal authority to bind such entity to this Agreement (in such cases, the terms “you”, “your”, “User”, or “Customer” shall refer to that corporate entity). If it is later determined that you do not have such authority, you will be held personally responsible for all obligations under this Agreement, including billing and payment obligations. HostGete shall not be liable for any loss, damage, or suspension resulting from our reliance on any instruction, ticket, or communication reasonably believed to be from an authorized representative of your corporate entity.
Trade and Sanctions Compliance
You represent and warrant that you comply with the following international trade and security conditions:
- Restricted Jurisdictions: You are not a resident of, and will not use or distribute our hosting infrastructure or services within, any country or region subject to comprehensive international trade sanctions or embargos upheld by the United Nations, or other major international regulatory bodies.
- Sanction Lists: You are not included on any official international sanctions list, blacklists, or restricted party lists maintained by competent global authorities.
- Ownership and Control: You are not owned, controlled, or directly/indirectly funded by any sanctioned individual or blocked entity, and you are not acting on behalf of, at the direction of, or for the benefit of any restricted party.
- Anti-Circumvention: You agree not to make HostGete’s Services or server resources indirectly available to any person, entity, or organization that fails to meet these compliance requirements. You also agree not to engage in or support activities intended to circumvent the safety, identity verification, or security restrictions outlined in these Terms of Service.
You acknowledge that the list of sanctioned countries, regions and persons are subject to change in accordance with the latest regulations, and you agree to comply with any such changes immediately as they occur. Also, if your status changes such that you are included on any sanctions list or become owned or controlled by the Sanctioned Party, you must promptly notify us. You agree to actively participate in sanctions screening and investigation processes, including to provide all necessary information as requested for sanction compliance purposes.
In the event that Hostinger becomes aware of, or reasonably suspects, that you are breaching sanction compliance clauses outlined in these Terms of Service, Hostinger reserves the right to terminate your use of the Services immediately and without any notice. Also, you agree to indemnify and hold Hostinger harmless against any losses, including, but not limited to, monetary penalties and legal fees, that may arise due to your non-compliance with the aforementioned sanctions compliance confirmations.
- ACCOUNT AND ITS MANAGEMENT
Account and Information: In order to access certain features of this Site or use the Services, you will have to create an Account. You represent and warrant to HostGete that all information you provide when creating your Account is accurate, current, and complete. You agree to maintain and promptly update Account information and any other information you provide to HostGete to keep it accurate, current, and complete. HostGete assumes no liability or responsibility for any issues or adverse outcomes that may occur due to inaccurate information provided by you. If HostGete has reason to believe that your Account information or any other information you provide is inaccurate, outdated, incomplete, or unjustified, HostGete reserves the right, in its sole and absolute discretion, to request you to validate the information (including providing required supporting documents, which might include government-issued business identification, address proof, or government-issued photo identification) or to suspend or terminate your Account.
For the avoidance of doubt, the individual or entity whose data is listed in the ‘Account Information’ section of the HostGete client area is considered to be the legal owner of the Account and the data and Services contained therein (excluding domain names, if any). Domain names are owned as set out in applicable ICANN and respective registry rules, and we will assist domain registrants to the extent permitted by applicable rules and regulations. If your Account contains domain names registered with us in the name of a third party, and that third party (domain name registrant) requests access to the management of those domain names, we may comply with the domain name registrant’s instructions and provide them with access to those domain names.
It is your absolute obligation to ensure that you correctly indicate ownership of your Account. If there is a dispute about ownership, access to the Account may be blocked or locked until the parties to the dispute agree on a resolution, or until the matter is finally resolved by a competent regulatory or judicial authority. We are not liable for any damages, losses, or service interruptions of any nature suffered by the Customer or any third party resulting from an ownership dispute or from the blocking of the Account.
Account Security: You are solely responsible for all activity that occurs on your Account. You agree to:
(i) Keep your Account secure and follow our security recommendations, including, but not limited to, using strong, unique passwords that adhere to industry-standard criteria, keeping different login credentials for different service providers, changing your password regularly, and enabling Two-Factor Authentication (2FA) for an added layer of security;
(ii) Maintain the absolute confidentiality of your password, support PINs, and other credentials related to the security of your Account. In the event of loss or disclosure of any means of authentication, you must immediately take available steps to secure your Account and Services (such as resetting your password);
(iii) Diligently verify the authenticity of any communication claiming to come from HostGete. If in doubt, contact us directly through our official support channels. HostGete will never request your account password, one-time codes (OTP), or credit card details via email or other unsolicited communication;
(iv) Be solely responsible for ensuring the security and compliance of any third-party applications, plugins, API connections, or automation tools you connect to your HostGete account;
(v) Notify HostGete immediately via support@hostgete.com or our official ticketing system of any breach of security or unauthorized use of your Account.
HostGete will not be liable for any loss you incur due to any unauthorized use of your Account. You, however, may be held liable for any loss HostGete or others incur caused by your Account, whether caused by you, or by any other authorized or unauthorized person.
Account Sharing and User Management: Our platform allows you to grant access (depending on permissions granted) to your Account or specific hosting services to another registered user or sub-account. You may revoke any person’s ability to access your Account at any time through your client dashboard.
By authorizing any person or sub-account to access your Account, you acknowledge and agree that:
(i) You have an established and trusted business or personal relationship with such a person;
(ii) You voluntarily authorize such person to access and/or make changes to your Account, websites, server configurations, or files;
(iii) Depending on the specific permissions granted, such person may be able to view personal information provided in your Account, including billing status and transaction logs (but excluding full payment method details);
(iv) Such person will be able to access your Account as it is on the day of granting access and also access any future infrastructure changes thereof (e.g., if access to a hosting plan is granted, they can access any future add-on domains or databases created under that plan);
(v) In case you allow that person to open support tickets or contact our team on your behalf, they will be able to receive technical information and/or manage Services using our support desk and access ticket history. Note that sub-users or invited accounts will not be allowed to perform core administrative actions, such as viewing or changing your main account credentials (like your master password) or deleting your main profile;
(vi) You assume full legal and financial responsibility (and undertake to fully release HostGete from any related liability) with respect to your decision to grant access to your Account to any person or with respect to any actions such person may take or fail to take with respect to your Account.
By requesting or accepting access to the Account of another HostGete customer, you undertake to use such access solely in the best interest of and as authorized by the customer granting access. Please note that HostGete is not involved in any separate contract or dispute between a customer granting access and the one receiving access. Should a dispute arise between the parties, you must address such dispute directly with the individual or business you are in contract with.
- AVAILABILITY OF SITE AND SERVICES, BETA SERVICES
Service Uptime & Maintenance: The service uptime guarantee applicable to specific Services, if any, is defined in the specific Hosting Agreement or Service Level Agreement (SLA) that forms part of this Agreement. You acknowledge and agree that from time to time this Site or our hosting servers may be inaccessible or inoperable for any reason including, but not limited to, scheduled maintenance, emergency repairs, critical software upgrades, or factors beyond our reasonable control (including, but not limited to, upstream data center network issues, hardware/equipment failures, DDoS attacks, or other unforeseeable cyber disruptions). You acknowledge and agree that HostGete assumes no liability or financial responsibility to you or any other party with regard to such temporary downtime or disruptions.
Beta Services: From time to time, HostGete may offer pre-release, trial, or experimental versions of new or existing Services (including new control panel features, automation tools, or optimization configurations) (“Beta Services”). By using any Beta Services, you agree to the following terms and conditions:
(i) You acknowledge and agree that the Beta Services are provided on an “as is”, “as available”, and “with all faults” basis, as they are pre-release experimental versions and may not function properly or be free of technical bugs;
(ii) You assume all operational risks and liabilities arising from and/or relating to your use of and reliance upon those Beta Services, and we make no representation or warranty with respect thereto;
(iii) We reserve the absolute right to modify, change, suspend, or discontinue any aspect of the Beta Services at any time without prior notice;
(iv) Final commercially released versions of the Beta Services may change substantially from the trial versions;
(v) Dedicated Customer Service or technical support team time allocated for Beta Services may be limited or provided on a best-effort basis;
(vi) You agree to provide prompt feedback regarding your experience with the Beta Services through support@hostgete.com or our feedback channels, which may be used by us for product development, optimization, or marketing purposes;
(vii) You agree that all technical logs and information regarding your use of the Beta Services, including your feedback, is confidential and must not be shared publicly or with third parties;
(viii) To the fullest extent permitted by law, HostGete disclaims any and all warranties, express or implied, with respect to the Beta Services, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement;
(ix) To the fullest extent permitted by law, HostGete shall not be held liable for any data loss, site crashes, or damages arising from your use of Beta Services.
Services Language & Localization: Our platform and technical services do not support all local languages. If a specific local language is not fully supported, the system interface and communication will default to English. Use of the Services or specific billing panels in certain local languages (other than English) or from specific regional jurisdictions may limit certain backend features, automation workflows, or local third-party payment method functionalities.
- GENERAL RULES OF CONDUCT
- The Site and the Services are intended for your commercial, professional, or legitimate personal development use. By utilizing them, you acknowledge and agree that your purpose is commercial or professional in nature.
- You agree to use this Site and the Services in full compliance with this Agreement and all applicable local and international laws.
- You shall not collect or harvest (or permit anyone else to collect or harvest) any Customer Content (as defined below) or any non-public or personally identifiable information about another Customer or any other person or entity without their prior written consent.
- You are prohibited from using this Site or the Services in a manner (as determined by HostGete in its sole and absolute discretion) that:
- Is illegal, promotes, or encourages illegal content, activity, products, or services (regardless of their form);
- Promotes, encourages, or engages in child pornography or the exploitation of children;
- Promotes, encourages, or engages in terrorism, war, violence, cyber-warfare, or hatred against people, property, or animals, or self-harm;
- Promotes, encourages, or engages in fraud and deception, including creating fake accounts, identity or account theft, data scraping, phishing, or Ponzi/pyramid schemes;
- Engages in online harassment, bullying, stalking, or other forms of abusive, defamatory, or intimidating behavior targeting any person or entity;
- Promotes, encourages, or engages in any computer or network hacking, cracking, distribution of malware, ransomware, or network scanning;
- Promotes, encourages, or engages in the (i) sale or distribution of prescription medication without a valid prescription and/or legal license; (ii) illegal wildlife trade;
- Infringes on the intellectual property rights, copyrights, trademarks, or other proprietary rights of another Customer or any other person or entity, or links to content hosted on third-party sites or servers that infringe such rights;
- Violates the privacy or publicity rights of another Customer or any other person or entity, or breaches any duty of confidentiality that you owe to another Customer or any other person or entity;
- Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognizable offense, or prevents investigation of any offense, or is insulting to any nation;
- Engages in or instigates actions that cause harm to HostGete, its infrastructure, or any other person. Such actions include, but are not limited to, actions resulting in the blacklisting of any of HostGete’s IP blocks by any online spam database (such as Spamhaus), or actions resulting in outbound/inbound DDoS attacks to or from any servers;
- Contains or installs any viruses, worms, bugs, Trojan horses, Cryptocurrency Miners (e.g., crypto-jacking scripts), or other code, files, or programs designed to, or capable of, utilizing excessive server resources, disrupting, damaging, or limiting the functionality of any software or hardware;
- Interferes with the normal operation of this Site or the infrastructure Services found at this Site;
- Contains false or deceptive language, phishing landing pages, misinformation, disinformation, or unsubstantiated or comparative claims (including regarding HostGete or our Services).
- Data Backups and Responsibility: You agree to maintain independent back-ups of all your Customer Content, including website files, databases, and email content, so that you can access and use it when needed. You are solely responsible for backing up your data in all circumstances. HostGete does not warrant or guarantee that it backs up any Account or Customer Content, and you accept the full risk of loss of any and all of your Customer Content.
- You shall not re-sell, lease, or otherwise exploit for unauthorized commercial purposes any of the Services (or portion thereof), including any of HostGete’s related infrastructure technologies or server controls, without HostGete’s express prior written consent.
- If you use HostGete’s APIs, automated modules, or integration tools, you are responsible for: (i) keeping your API keys, tokens, or WHMCS secrets confidential; (ii) rotating API keys periodically or as required by HostGete; (iii) ensuring that scripts or tools interacting with HostGete services follow our security recommendations and are used only for authorized purposes.
- You are solely responsible for any third-party services, applications, software, code, scripts, plugins, APIs, tools, or similar technologies that you install, connect, access, or otherwise use in connection with the Services (including but not limited to WordPress plugins or custom PHP scripts). You must ensure that such third-party technologies are secure, updated, and used in compliance with applicable laws and this Agreement.
- COMPLIANCE WITH LAWS
HostGete makes no representation or warranty that the content or Services available on this Site are appropriate or legally permitted in every country or jurisdiction. Your use of this Site or our Services from countries or jurisdictions where its content or hosting activities are illegal is strictly prohibited.
By accessing this Site or using our Services, you agree to be solely and fully responsible for complying with all applicable local, state, national, and/or international laws, rules, and regulations.
- CUSTOMER CONTENT AND CUSTOMER FEEDBACK
Some of the features of this Site or the Services may allow the Customer to view, post, publish, share, store, or manage:
(a) Ideas, opinions, recommendations, or advice (“Customer Feedback”); and
(b) Materials created, developed, provided, uploaded, linked, or displayed by the Customer in connection with the Services, regardless of whether such materials were created by the Customer or third parties. This includes any website designs, images, photos, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, code, algorithms, databases, interfaces, text, or literary works (“Customer Content”).
You are solely responsible for any and all Customer Content and Customer Feedback, as well as any transactions or other activities conducted on or through your Account. By posting, uploading, or publishing Customer Content or Customer Feedback to this Site or through our Services, you represent and warrant to HostGete that:
(i) You have all necessary intellectual property rights, licenses, consents, and/or permissions to distribute such Customer Content or Customer Feedback, either as the author or with appropriate written authorization from the legitimate rights holder; and
(ii) The Customer Content or Customer Feedback does not infringe upon or violate the rights of any third party (including copyrights, trademarks, or privacy rights).
Customers shall be solely responsible for any and all consequences (including legal claims or damages) and administrative requirements arising from using or hosting their Customer Content.
Customer Content Ownership & Limited License: As between HostGete and you, you shall retain all intellectual property rights pertaining to your Customer Content. By uploading or publishing Customer Content through our hosting infrastructure or Services, you grant HostGete a limited, non-exclusive, worldwide, royalty-free, and transferable license to use, reproduce, host, cache, and display your Customer Content strictly as necessary to operate, maintain, optimize, and deliver the hosting Services to you, consistent with the purpose of this Site and this Agreement.
The above limited licenses granted by you for your Customer Content terminate within a commercially reasonable time after you remove or completely delete your Customer Content from our servers. However, you understand and agree that HostGete may retain server log data or encrypted disaster-recovery backups containing such data for technical or legal compliance purposes as outlined in our retention rules. HostGete shall never utilize any Customer Content that has been designated as “private” or “password protected” by you for marketing or promotional purposes.
Customer Feedback: You acknowledge and agree that:
1) Your Customer Feedback is provided entirely voluntarily;
2) Your Customer Feedback is not confidential, and HostGete is not obligated to treat it as a secret;
3) HostGete has no obligation, either express or implied, to develop or use your Customer Feedback, and no financial compensation or royalty is due to you or anyone else for any use of your feedback;
4) HostGete may already be working on similar infrastructure ideas, may have received similar feedback from others, or may develop similar features on its own. HostGete shall own exclusive rights to any Customer Feedback provided directly to us and shall be entitled to the unrestricted use and dissemination of such Feedback for any operational or product-development purpose without acknowledgment or compensation to you.
- COMPLIANCE WITH LAWS
HostGete makes no representation or warranty that the content or Services available on this Site are appropriate or permitted in every country or jurisdiction. Your use of this Site or our Services from countries or jurisdictions where its content or hosting activities are illegal is strictly prohibited.
By accessing this Site or using our Services, you agree to be solely responsible for complying with all applicable local, state, national, and/or international laws, rules, and regulations.
- CUSTOMER CONTENT AND CUSTOMER FEEDBACK
Some of the features of this Site or the Services may allow the Customer to view, post, publish, share, store, or manage:
(a) Ideas, opinions, recommendations, or advice (“Customer Feedback”); and
(b) Materials created, developed, provided, uploaded, linked, or displayed by the Customer in connection with the Services, regardless of whether such materials were created by the Customer or third parties. This includes any designs, images, photos, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, code, algorithms, databases, interfaces, text, or literary works (“Customer Content”).
You are solely responsible for any and all Customer Content and Customer Feedback, as well as any transactions or other activities related thereof conducted on or through your Account. By posting or publishing Customer Content or Customer Feedback to this Site or through the Services, you represent and warrant to HostGete that:
(i) You have all necessary rights, licenses, consents, and/or permissions to distribute Customer Content or Customer Feedback in such manner, either as the author or with appropriate written authorization from the rights holder; and
(ii) The Customer Content or Customer Feedback does not violate the rights of any third party.
Customers shall be solely responsible for any and all consequences (including any damages, legal claims, or regulatory penalties) and requirements for using or hosting Customer Content.
Customer Content Ownership and License: As between HostGete and you, you shall own all intellectual property rights pertaining to your Customer Content. By hosting or publishing Customer Content through our Services, you grant HostGete a limited, worldwide, non-exclusive, royalty-free, and transferable license to use, reproduce, distribute, and display your Customer Content solely as necessary to operate, maintain, secure, improve, and technical-support the Services, consistent with the purpose of this Site and Agreement.
The above licenses granted by you in your Customer Content terminate within a commercially reasonable time after you completely remove or delete your Customer Content from our servers. However, you understand and agree that HostGete may retain technical backup copies of data as allowed pursuant to our backup and retention system policies. Notwithstanding anything to the contrary contained herein, HostGete shall not use any Customer Content that has been designated “private” or “password protected” by you for any promotional or marketing purposes.
Customer Feedback: You acknowledge and agree that:
1) Your Customer Feedback is entirely voluntary;
2) Your Customer Feedback is not confidential, and HostGete is not obligated to treat it as secret;
3) HostGete has no obligation, either express or implied, to develop or use your Customer Feedback, and no compensation or credit is due to you or anyone else for any use of your feedback;
4) HostGete shall own exclusive rights (including all intellectual property rights) to any submitted Customer Feedback and shall be entitled to the unrestricted use and dissemination of it for any purpose, commercial or otherwise, without acknowledgment or compensation to you or anyone else.
- HOSTGETE CONTENT
HostGete Content Ownership: Except for Customer Content, all content on this Site and within the Services, including data, text, software, scripts, source code, APIs, computer code (including HTML), applications, graphics, photos, sounds, videos, interactive features, artwork, website templates, themes, widgets, designs, animations, interfaces, methods, products, algorithms, logos, trademarks, service marks, and trade names contained on this Site and within the Services (“HostGete Content”), are owned by or licensed to HostGete. HostGete Content is protected by copyright, trademark, and other applicable intellectual property laws.
HostGete Content Usage: HostGete Content is provided to you “as is”, “as available”, and “with all faults” for your information and personal, non-commercial use only. It cannot be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any purpose without the express prior written consent of HostGete. No right or license under any copyright, trademark, patent, or other proprietary rights is granted under this Agreement. HostGete reserves all rights not expressly granted. However, HostGete hereby grants to the Customer a non-exclusive, non-transferable, non-sublicensable, fully revocable, limited license to use the HostGete Content solely to generate, configure, and display websites through the active Services provided by HostGete, and solely within the scope of the relevant purchased plan.
Security Restrictions: You agree not to bypass, disable, or otherwise interfere with any security-related features of this Site or the Services. This includes any features that protect, restrict, or limit the use or copying of any content on the Site, whether it is Customer Content or HostGete Content.
- MONITORING OF CUSTOMER CONTENT AND CONSEQUENCES OF INAPPROPRIATE CONTENT
By using this Site and/or any Service, you agree not to make available, host, or accessible any illegal content, malware, phishing material, spam scripts, or content that is incompatible with or violates this Agreement. HostGete generally does not pre-screen Customer Content hosted on our servers. However, HostGete reserves the right (but undertakes no obligation) to monitor, review, and decide whether any item of Customer Content is appropriate and complies with this Agreement and our Acceptable Use Policy (AUP).
In cases where (as determined by HostGete in its sole and absolute discretion):
(i) You make available, distribute, or host any material in violation of this Agreement;
(ii) You otherwise violate any part of these Terms of Service; or
(iii) HostGete has reason to believe that you are a repeat offender or involved in abusive activities,
HostGete may apply strict restrictions at any time, immediately, and without prior notice.
HostGete may apply the following enforcement restrictions:
(i) To immediately remove or disable access to any inappropriate item of Customer Content;
(ii) To suspend or terminate the Customer’s access to this Site, Client Dashboard, or Account; and/or
(iii) To suspend, restrict, or completely terminate the Account or Services (all or any part thereof).
If HostGete applies any of the above-mentioned restrictions due to policy violations, HostGete may, in its sole and absolute discretion, permanently remove and destroy any data, databases, and files (including automated back-up copies) stored by you on our servers, and shall have no obligation to provide or return such data and files to you.
You also acknowledge and agree that severe violations (such as child abuse material, cyber-attacks, or financial fraud) may be reported by HostGete directly to competent law enforcement and regulatory authorities in India or other relevant jurisdictions as determined by HostGete in its sole discretion.
- CONTENT MODERATION AND ABUSE HANDLING POLICY
This section outlines the provisions, processes, and disclosure mechanisms regarding content moderation, reporting of illegal activities, and service abuse on the HostGete Platform, ensuring a safe and secure hosting environment for all users.
Rules of Conduct & Prohibited Content: Customers are strictly prohibited from hosting, providing, publishing, distributing, or transmitting any Customer Content or engaging in any activity that violates this Agreement, applicable local laws (including the laws of India and West Bengal), or international legal regulations. Prohibited activities include, but are not limited to, hosting malware, phishing pages, spamming networks, child sexual abuse material (CSAM), copyright-infringing content, or any other form of “Illegal Content.”
Content Moderation Overview: HostGete, in its sole and absolute discretion, reserves the right to monitor, review, or determine whether our infrastructure or Services are being used in relation to Illegal Content or platform abuse.
HostGete may voluntarily take proactive action against any identified Illegal Content or infrastructure abuse. We may also receive formal notices through our Abuse Reporting Mechanism or lawful compliance orders from government, judicial, or law enforcement authorities. HostGete will process such orders and notices diligently and implement necessary restrictions, blocks, or service suspensions based on the available information. Upon becoming aware of clear Illegal Content, HostGete may enforce immediate restrictions without requiring a detailed legal examination.
Abuse and Illegal Content Reporting Mechanism: Any individual, organization, or authority may report the presence of content or server usage on our platform that they consider to be illegal, harmful, or a violation of our Terms of Service. All such abuse reports, trademark/copyright infringement notices, or legal complaints must be submitted directly to our compliance and abuse handling department via email at: support@hostgete.com.
Unfounded Notices & Platform Abuse: To prevent the misuse of our reporting infrastructure, if any person or entity frequently submits manifestly unfounded, malicious, or false abuse reports, HostGete reserves the right to suspend the processing of notices from that specific sender.
Measures and Tools for Review: Notices, legal orders, and subsequent moderation actions are generally subject to direct human review by our support and compliance specialists. However, HostGete may also utilize specialized automated tools and firewalls to detect high-risk activity, mitigate network attacks (such as DDoS), prevent fraud, and secure our hosting infrastructure. If our automated systems or trusted security partners flag an Account or Service as a direct, high-risk security threat (e.g., active phishing or malware distribution), immediate automated suspension may occur to safeguard the rest of our network. We regularly review these automated decisions to ensure they are applied accurately and objectively.
Internal Complaint and Appeal System: If you are a Customer and disagree with any content moderation, suspension, or termination decision made by HostGete, you may lodge a formal appeal electronically by contacting our compliance team through your client dashboard or via email at: support@hostgete.com. HostGete handles all appeals and complaints in a timely, non-discriminatory, and diligent manner.
- NO SPAM POLICY
We strictly prohibit the transmission of spam or unsolicited bulk communications through our Services and network. We actively monitor traffic to and from our servers for signs of spamming to maintain server reputation. Spam includes any unsolicited commercial or bulk messages sent via email, SMS, instant messaging, or other channels without the recipient’s prior explicit consent. In order to use our Services, you must abide by all applicable local and international anti-spam laws and regulations. This includes requirements that:
(i) Commercial advertising and/or bulk communication may only be sent to recipients who have “opted-in” to receive such messages;
(ii) All outgoing messages must include a legitimate return address, a valid reply-to address, and the sender’s physical address; and
(iii) A clear, functional opt-out or unsubscribe method must be provided within every message. Upon request by HostGete, you may be required to provide conclusive proof of recipient opt-in compliance.
When evaluating your compliance with our No Spam Policy, we are entitled to examine various factors, including recipients’ reactions to the messages received (e.g., number of messages marked as spam or complaints filed), sender profile verification and authentication (such as proper SPF, DKIM, and DMARC configurations), behavioral indicators, sending patterns, and domain/IP reputation checks. For this purpose, we reserve the right to view and otherwise analyze the metadata and volume patterns associated with the messages.
If we determine, in our sole and absolute discretion, that the Customer or User has violated this No Spam Policy or any provisions of this Agreement, we reserve the right to suspend any or all related Services immediately. In limited and isolated cases, the Services may be restored subject to our review and decision, provided the Customer undertakes to cease all spam activities and fixes the underlying issue.
In the event that we determine, in our sole and absolute discretion, that the spam violation is manifestly abusive, malicious (e.g., intentional phishing/pharming), or has not stopped after the initial suspension, we may immediately terminate the Services related to the spam activities and/or close your Account without any refund.
We encourage all recipients of messages generated from our infrastructure to report suspected spam. Suspected abuse or spam activities can be reported directly via email at: support@hostgete.com.
- ARTIFICIAL INTELLIGENCE (AI) SERVICES
HostGete may provide you with access to artificial intelligence and machine learning tools, plugins, or automated helpers to assist in building and managing your website, generating text/content, enhancing other aspects of your online presence, or performing any other actions instructed by you (“AI Services”). This section applies strictly to the extent that AI Services are utilized by you as part of the HostGete Services.
Input and Output: The AI Services enable you to input, provide, or submit prompts, instructions, URLs, or other materials (in the form of text, images, or otherwise) (“Input”) into the system for processing, directing the AI Services to generate content, designs, codes, or perform certain actions in response (“Output”). The Input submitted by you and the Output generated through our AI Services are considered Customer Content. HostGete does not claim any ownership rights in the Output, provided that the Output does not contain any preexisting intellectual property owned by HostGete or our direct infrastructure partners.
Output Accuracy and Liability: You are solely responsible for reviewing the generated Output for accuracy, bias, appropriateness, or intellectual property rights clearance. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional, legal, or technical advice. HostGete does not guarantee that the Output will be unique, original, or free from third-party intellectual property claims.
By using the AI Services, you acknowledge and agree that:
(i) You are solely responsible for ensuring that any Input and Output complies with all applicable laws, including intellectual property and privacy laws, and does not infringe third-party rights;
(ii) You are fully responsible for the Inputs you provide and any actions taken or deployed on your servers based on those Outputs;
(iii) You understand the nature and technical limitations of AI-generated content and assume all operational risks associated with using these AI Services;
(iv) HostGete makes no representations or warranties regarding the legality, originality, accuracy, stability, or non-infringement of any Output. You should conduct independent due diligence before using, distributing, or commercializing any Output;
(v) You authorize HostGete to store and process Input and Output for the purpose of providing you with the Services, troubleshooting, and improving our internal system tools;
(vi) AI Services may perform certain operational tasks or configurations within your hosting environment based on your prompt or instructions. This may include interacting with your Account, Customer Content, or connected third-party tools/APIs;
(vii) AI Services may interpret your prompt and determine the best way to execute an action. You remain solely responsible for reviewing and managing any automated actions that affect your website, files, databases, or service configurations.
- ADDITIONAL RESERVATION OF RIGHTS
HostGete expressly reserves the right to deny, cancel, terminate, suspend, lock, or modify (including access to or control of) any Account and/or Services (including the right to cancel or transfer any domain name registration) for any legitimate reason, as determined by HostGete in its sole and absolute discretion, including the following:
(i) To correct technical mistakes or billing errors made by HostGete in offering, pricing, or delivering any Services;
(ii) To protect the integrity and stability of, and correct mistakes made by, any authorized domain name registry or registrar partner;
(iii) To support our automated or manual fraud and abuse detection, mitigation, and prevention efforts, as well as to prevent any activities that threaten the stability of our network, nodes, or servers;
(iv) To comply with: (a) lawful courts’ or law enforcement authorities’ orders against you and/or the Services used by you, including subpoena or regulatory compliance requests; (b) any official dispute resolution process or defense of any legal action; (c) applicable local, state, national, and international laws, rules, and regulations;
(v) To avoid any civil or criminal liability on the part of HostGete, its founders, team members, and infrastructure affiliates;
(vi) To mitigate immediate risks of damage to HostGete’s business brand, operations, server uptime, and overall reputation.
Harassment Policy: HostGete expressly reserves the right to terminate and/or suspend (including cutting off access to or control of), without any prior notice to you, your Account and any associated Services, if, in HostGete’s sole discretion, you are harassing, abusing, bad-mouthing, or threatening HostGete or any of HostGete’s support staff and technicians.
Technical Support Access Rights: HostGete expressly reserves the right to access, view, edit, and/or modify your Account settings, hosting environment, server configurations, or Customer Content in order to assist you when you reach out to our Customer Support via ticketing systems, live chat, or email (support@hostgete.com).
Operational Oversight: HostGete reserves the right, but undertakes no constant duty, to review the use of our Services and Account activities for any patterns that may pose a direct risk to HostGete’s infrastructure. HostGete may review, adjust the server resource limits of, or change the security settings of any hosted environment that HostGete believes, in its sole and absolute discretion, may pose a security threat, cause server crashes, or degrade performance for other environments on the same network node.
- LINKS TO THIRD-PARTY WEBSITES
This Site and the Services may include (through hyperlinks, banner advertising, or otherwise) links to third-party websites that are not owned or controlled by HostGete (“Linked Sites”). HostGete assumes no responsibility for the content, terms and conditions, privacy policies, or practices of any Linked Sites and does not monitor or modify their content. By using this Site or the Services, you expressly release HostGete from all liability arising from your use of any Linked Sites. We encourage you to review the terms and privacy policies of any Linked Sites you visit. Unless otherwise described on the Site, the existence of any links to Linked Sites does not constitute an endorsement of such websites, their content, or their services and/or products. - FEES, PAYMENTS, REFUNDS AND AUTO-RENEWAL
General Terms: You agree that your Payment Method (as defined below) will be charged by HostGete or its authorized payment gateway partners in the course of purchasing Services. All our paid Services are provided on a subscription basis, unless indicated otherwise. You choose the period of Services and the Payment Method yourself when you purchase the Services. After your chosen subscription period ends, the provision of Services will be auto-renewed for an additional subsequent subscription period. By purchasing Services on a subscription basis (e.g., monthly, annually, or otherwise) and submitting your payment information, you explicitly agree and consent that (i) Services will be auto-renewed until you disable the auto-renewal feature, and (ii) you are authorizing recurring payments.
By purchasing our Services, you agree to provide accurate, complete, and up-to-date information and documents (including personal and payment-related information, as well as information required for regional tax regulations or GST exemptions), and you confirm that you are the rightful owner of such provided information. You also agree to maintain the accuracy of this information throughout your use of the Services. Please note that once an invoice is issued based on the details available in your Account, it is considered final and cannot be altered.
As a general rule, requests and claims related to payments made for the Services (including refunds) will be handled only if they are submitted no later than within 30 (thirty) calendar days of the date of purchase of the Service, unless specified otherwise in our explicit Refund Policy or required by applicable consumer protection laws.
Fees and Payment of Fees: You agree to pay any and all fees due for Services at the time you order them. The total amount of fees for your selected Services period shall be charged and paid by you upfront, unless otherwise specified on this Site. All fees posted on this Site for Services are exclusive of applicable taxes. Nevertheless, you agree that we may calculate, add, and charge relevant taxes (including Goods and Services Tax – GST, or other statutory levies) under the laws applicable to you or based on the country/state indicated in your Account at the time of purchase or renewal. You are solely responsible for all taxes, duties, and fees levied on the Services.
Prior to purchasing or renewing Services, we or our payment gateway processors may initiate a pre-authorization transaction on your designated Payment Method. A nominal amount may be temporarily charged or held to validate the status and validity of your card or payment account. Upon successful verification, this amount will be promptly reversed and will not reflect as a permanent charge.
Payment Failures, Disputes, and Chargebacks: If for any reason HostGete is unable to charge the Payment Method linked to your Account for the full amount owed, or if HostGete receives a notification of a chargeback, payment reversal, payment dispute, or is charged a penalty fee for any transaction, you agree that HostGete may pursue all available lawful remedies to obtain payment. This includes the immediate cancellation, suspension, or termination, without prior notice to you, of any or all Services associated with your Account. Suspension or termination under these circumstances may result in a permanent loss of access to your hosted data, files, websites, and server environments.
HostGete also reserves the right to charge you reasonable administrative or processing fees for: (i) specialized tasks HostGrid/HostGete staff perform outside the normal scope of its standard Services, (ii) additional technical time or legal costs incurred by us in maintaining your Services due to compliance issues, and/or (iii) your non-compliance with this Agreement. These administrative fees will be charged directly to the Payment Method or Billing Account linked to your Account.
Currency and Conversions: HostGete may offer pricing displays in various currencies. However, payment processing is officially supported by the standard currencies displayed on our checkout portal (“Supported Currency”). If the payment is processed in a currency that differs from the base currency of your bank account or card issuer, you may be charged currency exchange rate conversion fees or foreign transaction fees by your financial institution, for which HostGete carries no liability.
Fee Changes: HostGete expressly reserves the right to change, modify, or adjust its service fees (including subscription renewal rates) at any time. Such modifications shall be posted online on our Site and shall take effect immediately upon your next service renewal cycle, without requiring further distinct notices to you. Your continued use of the Services after the modifications take effect constitutes your full acceptance of the revised fees.
Payment Methods: Except as prohibited in any specific service agreement, you shall pay for Services utilizing any valid and eligible payment methods supported on our site or via available balance inside your HostGete Wallet/Account Credits (each a “Payment Method”). You represent that the Payment Method you use belongs to you or that you are authorized by its owner to use it, and you authorize HostGete to charge the chosen method for all chosen infrastructure solutions. Once an order is completed, confirmation will be sent automatically to the email address indicated in your Account.
Auto-Renewal Feature: To ensure you do not experience an interruption or loss of website hosting, domains, or server data, all Services include an automated renewal feature by default, unless deactivated via your client dashboard. Auto-renewal automatically extends your active service at the end of each subscription period for an equivalent term at the then-current standard renewal rates. Unless you disable auto-renewal before your designated billing date, HostGete will process the renewal payment automatically using your default Payment Method. It is your sole responsibility to modify and maintain your Account renewal settings, and you agree that a failure to do so resulting in service expiration or data loss carries no liability for HostGete.
Refunds: All fees paid for Services are non-refundable (even if your Services are suspended, terminated, or restricted prior to the end of your subscription term), unless explicitly and strictly specified inside our corporate Refund Policy. If a refund is approved and issued to your original Payment Method, HostGete’s issuance of a refund invoice is our sole confirmation that the transaction has been submitted to the processing bank; HostGete has absolutely no control over banking processing windows or when the funds will appear on your statement. If your payment provider or issuing bank imposes restrictions on receiving automated reversals, HostGete reserves the absolute right to issue the refund in the form of internal Account Credits or Wallet Balances instead.
HostGete Balance / Account Credits: You can verify your available credits or wallet balance at any time by logging into your client area. Available credits may be applied to any future infrastructure purchase or manual renewal inside your Account. You acknowledge that HostGete Balance credits are non-transferable, can only be used in the specific Account where they were acquired, do not accrue any interest, and will expire exactly 2 (two) years from their initial date of issuance. If your Account is terminated due to policy breaches, any remaining balance or credit shall be forfeited. You hereby authorize HostGete to utilize any available internal credits to cover any outstanding or overdue invoices related to your Account.
- PRODUCT SPECIFIC TERMS AND THIRD-PARTY PRODUCTS
Third-Party Services, Licences, and Products: By ordering, activating, or utilizing third-party services, software licenses (such as cPanel, WHMCS, CloudLinux, or LiteSpeed), or specific products through HostGete, you acknowledge and agree to comply with the terms of service, end-user license agreements (EULA), and privacy documentation of those respective third-party providers.
HostGete acts solely as an intermediary reseller or facilitator for these third-party licenses and tools, enabling their integration with your hosting environment. We are not responsible for the independent operational uptime, internal software bugs, or architectural changes of third-party systems. Any automated credits, promotional licenses, or API tools provided under third-party integrations may carry operational limitations, resource caps, or specific expiration windows, and unused/expired allocations hold no monetary or refundable value.
- SERVICE CHANGES AND DISCONTINUATION
HostGete reserves the right to change, modify, update, or cease offering any Service (or any specific feature/plan thereof) at any time, with or without prior notice. While we strive to maximize the lifecycle and stability of our hosting infrastructure, certain legacy software versions, server operating systems, or hosting packages may be discontinued or reach their End-of-Life (“EOL”), after which they will no longer be active or supported on our network nodes.
If a critical Service or server environment reaches EOL, we will make reasonable commercial efforts to notify you at least 30 (thirty) days in advance via email or your client dashboard. You assume full and absolute responsibility for migrating your website files, configurations, and databases to a compatible environment or modern plan before the EOL date. At our sole discretion, HostGete may assist in migrating your account to a comparable current Service for the remainder of your active term, provide a prorated store credit, or issue a prorated refund. HostGete may also, with or without notice, upgrade your account environment to the most stable, secure, and up-to-date software versions available, and you assume full responsibility for ensuring your application’s compatibility with such security upgrades.
- DISCLAIMER OF REPRESENTATIONS AND WARRANTIES
You specifically acknowledge and agree that your use of this Site, our network infrastructure, and our Services shall be entirely at your own risk. All Services are provided on an “AS IS”, “as available”, and “with all faults” basis.
HostGete, its founders, team members, and upstream hardware/network providers disclaim all statutory, express, or implied warranties—including any warranties of uptime availability, data integrity, merchantability, fitness for a particular deployment, and non-infringement. We make no warranties and assume no operational liability regarding:
(i) The absolute accuracy, completeness, or uninterrupted reliability of this Site, server nodes, or connected networks;
(ii) The Customer’s ability to access the Services or client area flawlessly at every single moment or location of their choosing;
(iii) The perfect compatibility of our hosting environments with every third-party plugin, script, or custom application software.
In addition, no oral or written advice, technical guidance, or support input provided by HostGete staff (via support tickets, live chat, or emails) shall constitute binding legal, financial, or absolute structural advice, nor shall it create a warranty of any kind.
- LIABILITY, LIMITATIONS AND EXCLUSIONS
Liability Limitations: HostGete (including its founders, technicians, and system administrators) shall only be held liable for direct damages proven to be caused by gross negligence on our part. Under no circumstances shall HostGete be liable to you or any third party for any indirect, incidental, special, punitive, or consequential damages whatsoever—including but not limited to loss of business, revenue, profits, data, website SEO rankings, or operational opportunities—even if we were advised of the possibility of such damages.
Exclusions: HostGete carries no liability or operational responsibility for damages or losses resulting from:
(i) System downtime, server reboots, network latency, or fiber cuts beyond our immediate perimeter;
(ii) Any structural data loss, corrupted databases, or broken sites, whether due to script errors, software vulnerabilities, or hardware wear-and-tear (Customers are strictly reminded to maintain their own external, independent off-site backups);
(iii) Unauthorized access to your client area, panels, or email accounts resulting from weak customer passwords or compromised local devices;
(iv) Malicious third-party conduct, including DDoS attacks, malware injection, hacking, or web defacement targeting your hosted applications;
(v) Structural interruptions caused by global force majeure events or data center network failures.
Monetary Cap on Liability: Notwithstanding anything to the contrary contained herein, you specifically agree that any cause of action arising out of or related to our Services must be commenced within 12 (twelve) months after the issue occurs, or it shall be permanently barred. In no event shall HostGete’s total cumulative financial liability exceed the actual amount of fees paid by you for the specific affected hosting service in the 12 (twelve) months immediately preceding the cause of action.
- INDEMNITY
You agree to protect, defend, indemnify, and hold harmless HostGete, its founders, and team members from and against any and all claims, regulatory demands, costs, liabilities, legal expenses, and monetary damages asserted or filed by any third party against us due to:
(i) Your specific use of our servers, network resources, or client accounts;
(vi) The nature of the content hosted on your websites (including copyright disputes, trademark violations, or illegal data deployments conducted by your end-users);
(iii) Your direct violation of any provision of this Agreement or applicable cyber laws. - GOVERNING LAW AND DISPUTE RESOLUTION
Governing Law: This Agreement, its interpretation, and any operational disputes arising from it shall be governed exclusively by and construed in accordance with the laws of the Republic of India.
Dispute Resolution: In the event of any technical dispute, billing misunderstanding, or contractual claim, you and HostGete agree to make exhaustive, good-faith efforts to resolve the matter amicably via our internal compliance channels or support ticketing system before initiating formal proceedings. You hereby explicitly agree that any judicial proceedings or legal actions to resolve claims relating to this Agreement shall be brought exclusively in the competent courts located in West Bengal, India.
- GENERAL PROVISIONS
Successors and Assigns: HostGete may assign or transfer its operational rights and obligations under this Agreement, including engaging upstream infrastructure partners, network providers, or system administrators to perform specialized maintenance tasks, without requiring your prior explicit consent.
Force Majeure: HostGete shall not be held liable for any failure or operational delay in fulfilling its obligations under this Agreement if such failure is caused by events completely beyond our reasonable control—including acts of God, extreme natural disasters, severe cyber warfare/DDoS attacks, widespread telecommunication fiber outages, electricity grid gridlocks, or governmental restrictions.
Severability: If any provision or specific clause of this Agreement is found to be illegal, invalid, or otherwise unenforceable by a competent court of law, the remaining structural provisions shall remain in full force and effect to the maximum extent permitted by law.
Language of the Agreement: This Agreement is originally written and executed in the English language. Any translations provided are strictly for convenience; in the event of any discrepancies between a translated version and the English layout, the English layout shall absolutely prevail.
