Transfer and Disclosure of Data to Competent Authorities: In certain situations, HostGete may be required to disclose personal data in response to lawful requests by public, judicial, or law enforcement authorities, including when it is required to meet national security or legal investigation requirements, and will do so where permitted or mandated by applicable local laws.
11.3. Data Localization Obligations
If you reside in a jurisdiction that imposes “data localization” or “data residency” obligations (i.e., requiring that Personal Information of its residents be kept within the territorial boundaries of such country/jurisdiction), and this fact is brought to our attention, we may maintain your Personal Information within such territorial boundaries if we are legally obligated to do so and if technically supported by your purchased plan. You acknowledge that while doing so, we may continue to collect, store, and use your technical and account information through our global infrastructure to provide uninterrupted services.
11.4. Targeting and Advertising
We use marketing, analytics, and advertising tools provided by platforms like Google and Facebook (Meta). You should carefully review the privacy policies of these respective service providers to understand their data collection practices, targeted advertising mechanisms, and your opt-out rights.
11.5. Social Media Features and Widgets
Our Services may include certain Social Media features, widgets, and single sign-on (SSO) integration, such as “Google Sign-In” or “Facebook Connect,” as well as sharing buttons or interactive mini-programs. These Social Media Features may collect technical data such as your IP address or which page you are visiting on our Website, and they may set cookies to enable them to function properly. These features are governed entirely by the privacy policies of the respective third-party providers hosting them.
11.6. Legal Obligation to Disclose Personal Data
We will reveal your Personal Data to regulatory, state, or public authorities without your prior permission only when we are legally required to provide such information. This includes responding to legal processes, defending our legal rights, or cases where we have a good faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to:
- Meet any applicable law, regulation, legal process, or enforceable governmental request;
- Enforce our applicable Terms of Service, including the investigation of potential violations or service abuse;
- Detect, prevent, or otherwise address fraud, network security, or technical infrastructure issues.
11.7. Other Disclosures
We may share your personal data in manners other than as described above only pursuant to your explicit consent, or if we are legally obligated or compelled to do so by a court of law.
- SECURITY
HostGete has implemented security measures designed to protect the Personal Information you share with us, including physical, electronic, and procedural measures. Among other things, we offer HTTPS secure access to most areas on our Services. We also regularly monitor our systems for possible vulnerabilities and attacks, and regularly seek new ways and Third-Party Services for further enhancing the security of our Services and protection of our Visitors’ and Users’ privacy.
Regardless of the measures and efforts taken by HostGete, we cannot and do not guarantee the absolute protection and security of your Personal Information, or any other User Content you upload, publish, or otherwise share with HostGete or anyone else.
We therefore encourage you to set strong, unique passwords for your User Account and avoid providing us or anyone with any sensitive information of which you believe its disclosure could cause you substantial or irreparable harm.
If you have any questions regarding the security of our Services, you are welcome to contact us at support@hostgete.com.
- YOUR RIGHTS
You are entitled to a range of rights regarding the protection of your Personal Data, which are subject to limitations, restrictions, and conditions as laid down in applicable data protection laws. Those rights include:
- The right to access the information we process about you;
- The right to rectify incorrect/inaccurate or incomplete information about you;
- The right to transfer all or part of the information collected about you to yourself or another data controller, where technically feasible (the right to data portability);
- The right to erase any data concerning you. Users may demand erasure of data without undue delay for legitimate reasons, e.g., where data is no longer necessary for the purposes it was collected, or where the data has been unlawfully processed (subject to the retention rules stated in Section 10);
- The right to the restriction of data processing. Users, for legitimate purposes, may obtain restriction of data processing from the controller;
- The right to object to the processing of Personal Data when processing is carried out on the basis of legitimate interest, as well as in cases of the use of your personal data for direct marketing purposes, as specified in this Policy.
Some of the rights listed above are easy to exercise: for instance, you may at any time access, edit, update, or amend your details, or opt out of receiving communications from us by visiting and adjusting your personal account settings within your client area, or by emailing us at support@hostgete.com.
When you object to the processing of Personal Data where processing is carried out on the basis of our legitimate interest, we will carefully consider such a request, which may result in your Account closure, suspension, or deactivation due to technical limitations.
Where the processing of your personal data is based on your consent, you can withdraw your consent at any time by contacting us at support@hostgete.com.
Users have the right to lodge a complaint with the competent Data Protection Authority in their country of residence in the event where they believe their rights have been infringed. However, we highly recommend attempting to reach a peaceful and quick resolution of any possible dispute by contacting our team first.
Automated Individual Decision-Making, Including Profiling
In certain cases, we may make automated decisions related to you. We may use technology to assess your personal situation, system usage, and other factors to predict potential risks or outcomes (this practice is known as profiling), primarily for fraud prevention and network security. We implement this to make decisions that are fair, consistent, and informed by accurate data.
In cases where a decision based solely on automated processing produces legal effects concerning you or similarly significantly affects you, you have the right to contest the decision, express your point of view, and request human intervention. You can do this by contacting our Customer Support team through your dashboard or by using the email indicated in this section. We will review your request and provide a human review of the system decision, ensuring that your rights are fully respected.
For example, we make automated decisions and profiling in the following cases:
- Fraud Prevention Checks: We perform automated fraud prevention checks before a purchase or order is accepted. This helps to protect our genuine customers, our infrastructure, and our website from potential risks of fraud, consumer scams, billing disputes, or payment abuse. This processing is necessary for the proper performance and fulfillment of our contract with you. If our automated system, based on specific data and behavior patterns, determines that a transaction poses a high security or fraud risk, we will be able to block or halt the completion of that purchase.
- Discount and Promotional Evaluations: We utilize automated logic to evaluate whether to apply a discount, credit, or promotional offer to the price of the product or service you are purchasing. This logic is used strictly to provide benefits or incentives and will never be used to increase the price of the product or service you want to purchase. This processing is based on our legitimate business interest to enhance customer experience and encourage long-term commitment.
- Service Abuse Risk Assessment: We assess the risk of abuse or any other use of our infrastructure that is inconsistent with our Terms of Service to apply appropriate and timely mitigation measures. We use automated systems that help identify user accounts that are likely to be involved in abusive activities (such as spamming, phishing, malware hosting, or server resource overloading) based on behavior patterns, technical logs, and historical account data. Based on the identified risk level, proportional automated measures may be applied, including automated identity verification requests, temporary suspension of services, account restrictions, or other safeguards as per our Terms of Service. This processing is based on our legitimate interest in preventing platform abuse and ensuring the stable performance of our contract with you.
